Website description:
The website offers aromatised wine drinks, which are labelled as wine contrary to legislation. The website is in Czech language and products can be purchased for Czech crowns. At the time of inspection, it was not possible to order the offered goods (the term "Unavailable - in production" appears in the shopping cart), however, the inspection revealed that it was possible to order the goods in the past, and it is not excluded that the website will be fully functional again.
What to watch out for:
1) In the Trade Terms available on the website, company Kouzelne Víno - European Trade Foundation SE (ID: 09809139) with its registered office at Revoluční 1082/8, Nové Město, 110 00 Prague is stated as the seller. However, at the address, there is only the so-called "virtual headquarters" of the company along with about 1,200 other companies.
2) The Czech Agriculture and Food Inspection Authority (CAFIA) has repeatedly received complaints from consumers that they have ordered products on this website and paid for them in advance but they have never received the ordered goods. CAFIA therefore drew the attention of the Police of the Czech Republic to the above-mentioned facts because in its opinion, this could be a factual basis of unjust enrichment.
3) The operator of the website provides misleading information about the nature of the food (infringement of Article 7 Para 1 (a) of Regulation (EU) No. 1169/2011) as wine is not concerned, but aromatised wine drinks. The seller also does not state the information on the allergen - sulphur dioxide contained in the drinks in question.
4) The operator of the website also failed to take the measures imposed by the supervisory authority (CAFIA) pursuant to provision of Section 5 Article 1 (c) of the Act No. 146/2002 Coll., as amended.
5) According to database https://www.nic.cz/whois/contact/WEDOS-K8C-388073/, Massimo Sbrilli from company Online Trade Industries s.r.o., Jaurisova 515/4, 14000 Prague 4 is the holder of the domain name.
