The websites offer, inter alia, unsafe foodstuffs. The websites are in Czech language. The offered products could be purchased for Czech crowns. Mostly food supplements of various categories are offered here.    

1) The inspection revealed and proved that an unsafe food is offered for sale on these websites. Namely, Swiss Pharmaceuticals Eca Extreme dietary supplement à 60 capsules with content of yohimbine (which was proved by a laboratory) is concerned; it is regarded as unsafe according to Article 14 of Regulation (EC) No. 178/2002 and therefore it must not be placed on the market. The use of products derived from the bark of Pausinystalia johimbe is prohibited under Regulation (EC) No. 1925/2006. Consumption of food containing yohimbine can lead to health damage.

2) The e-shop also offers further foodstuffs that could be other than safe for consumers due to the declared composition in the meaning of Article 14 of Regulation (EC) No. 178/2002, for example WXN Labs Yohimbine à 100 capsules, Brutal Labz Yohimbine à 100 capsules, Dark Labs Double Yohimbine à 100 capsules, Swiss Pharmaceuticals Yohimbine HCl à 100 capsules, USA Supplements LLC Yohimbine HCl 10 mg à 200 pills, Skull Labs Angel Dust 270 g are concerned.

3) Furthermore, the content of the website seriously violates requirements laid down by legislation as the presented food supplements and their ingredients are connected with information that attributes properties to foodstuffs or their ingredients which enable to prevent, mitigate or cure certain human diseases. This is therefore in contradiction to Article 7 (3) of Regulation (EU) No. 1169/2011. The operator also provides misleading information about selected food producers of selected foods. Some information mandatory pursuant to Regulation (EU) No. 1169/2011 is missing as well.

4) According to the Trade terms of the e-shop (8.december 2021), company USA NUTRITION GROUP LLC., Northwest Registered Agent LLC, 90 State Street, Suite 700, Office 40, Albany, NY, 12207, Company number: 211102000046 from the United States of America is the seller. However, this entity does not respond to CAFIA notices and fails to remove the detected illegal state.

5) According to database https://www.nic.cz/whois/domain/americkedoplnky.cz/, Mr. Martin Krak representing company USA NUTRITION GROUP LLC is the holder of the domain name, who also does not respond to CAFIA notices and fails to remove the illegal state.

6) With regard to the fact that the entity administrating the Internet domain in question is located outside the territory of the CR, activities of Czech supervisory bodies towards the operator of the websites are very limited.
